MFA Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Moms for America Action website and related online services (the “Service”), operated by Moms for America Action (“MFAA,” “we,” “us,” or “our”). MFAA is the C4 advocacy arm of Moms for America. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Use of the Website
You agree to use the Service only for lawful purposes and in a manner consistent with our work. You may not use the Service in any way that violates applicable laws or regulations, attempt to interfere with the operation or security of the Site, or use the Site to distribute malicious software or harmful content. We reserve the right to restrict or terminate access for misuse.
2. Donations, Purchases, and Payments
If you make a donation, purchase merchandise, or register for an event through the Service, you may be required to provide payment information. You represent that you are authorized to use the payment method provided and that all information submitted is accurate and complete. Payments are processed through third-party payment processors. We do not store full payment card information. We reserve the right to refuse or cancel transactions in cases of suspected fraud, errors, or violations of these Terms. Unless otherwise stated, donations are non-refundable to the extent permitted by law.
Contributions and Tax Treatment. Moms for America Action is a 501©(4) organization. Contributions to Moms for America Action are not tax-deductible as charitable contributions for federal income tax purposes. We recommend you consult your tax advisor regarding your specific situation.
3. Availability and Accuracy of Information
We strive to provide accurate and up-to-date information, but the Service may occasionally contain errors, omissions, or outdated content. We reserve the right to correct or update information at any time without notice.
4. Promotions and Campaigns
Any contests, sweepstakes, fundraising campaigns, advocacy campaigns, or promotions may be governed by additional terms. In the event of a conflict, the specific promotion rules will control.
5. Intellectual Property
All content on the Service including text, graphics, logos, videos, images, and other materials is owned by or licensed to Moms for America Action and is protected by U.S. and international intellectual property laws. You may view, download, and print content for personal, non-commercial use only. No content may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written permission.
6. Third-Party Links
The Service may include links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of third parties. Accessing third-party sites is at your own risk.
7. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or misuse the Service. Provisions that by their nature should survive termination will remain in effect.
8. Indemnification
You agree to indemnify and hold harmless Moms for America Action, its officers, directors, employees, volunteers, and agents from any claims, damages, losses, liabilities, or expenses including reasonable attorneys’ fees arising out of your use or misuse of the Service, your violation of these Terms, or any content you submit through the Service.
9. Limitation of Liability
To the fullest extent permitted by law, Moms for America Action shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free access to the Service or that it will be free from harmful components. Content provided through the Service is for informational, educational, and advocacy purposes only and does not constitute legal, medical, financial, or professional advice.
Advocacy and Political Content. The Service may include communications related to legislation, public policy, civic engagement, and advocacy issues. Content is provided for informational and advocacy purposes and reflects MFAA’s viewpoints. Nothing on the Service should be construed as legal advice.
11. No Guarantees or Outcomes
Moms for America Action does not guarantee specific results, outcomes, legislative action, electoral outcomes, or impacts from participation in our campaigns, initiatives, or events. Engagement and outcomes depend on many factors beyond our control.
12. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of God, war, government actions, labor disputes, or failures of third-party service providers.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Missouri.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use personal information.
15. Children’s Privacy
The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If such information is discovered, it will be deleted promptly.
16. User Content and Testimonials
If you submit comments, testimonials, photos, or other content, you grant Moms for America Action a non-exclusive, royalty-free license to use, display, and share that content for informational, educational, advocacy, organizing, or promotional purposes unless you request otherwise. You may request removal of testimonials by contacting us.
17. Community Areas
If the Service includes forums, comments, or interactive features, information shared in these areas may be public. Please exercise caution when sharing personal information.
18. International Use
The Service is operated from the United States. By using the Service, you consent to the transfer and processing of information in the U.S. and other jurisdictions where service providers operate.
19. Changes to These Terms
We may update these Terms from time to time. Changes become effective when posted. Continued use of the Service after updates constitutes acceptance of the revised Terms.
20. Miscellaneous
These Terms constitute the entire agreement between you and Moms for America Action regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect.
